The purpose of the GC&E Function is to promote, oversee and build the Group’s capability to drive ethical behaviours and ensure compliance with externally defined laws and regulations, the Code of Conduct and related Group standards, through the development, implementation and maintenance of an effective ethics and compliance programme.
 
The Compliance and Ethics Manager Refining and Marketing is assigned work for specific R&M businesses in Europe, Middle East and Africa and is expected to use their expertise in higher risk areas such as competition law and anti-bribery and corruption to support the businesses in managing heir ethics and compliance risks.
 
 
Key accountabilities
  • Assisting in the delivery of an annual ethics and compliance strategy and goals for the Segment.
  • Assisting in the implementation of ethics and compliance risk mitigation tools and processes for the assigned businesses.
  • Maintaining an oversight and coaching relationship on ethics and compliance risks for the assigned businesses and Leadership teams.
  • Providing training to build an understanding and ownership of ethical leadership within the businesses.
  • Provide training on key compliance risks and in areas of the Code of Conduct for the assigned businesses.
  • Professional oversight and assessment of the identification, management and mitigation of compliance and ethics risks within the assigned businesses.
  • Maintaining and enhancing the programme to support the population of CELs within the assigned businesses – education and learning, CEL deliverables and accountabilities, and role descriptions
  • Developing and maintaining cross functional (Audit, HR, PSCM etc.) dialogue and collaboration around ethics and compliance risk mitigation within the assigned businesses.
  • Responsible for facilitating annual certification across the assigned businesses ensuring certification takes place and that all business leaders deliver certificates.
  • Contributing to discrete hands on risk mitigation work within the Segment as required.
 
 
Essential criteria & qualifications
 
Educational background
  • Degree and/or equivalent professional qualification. Law degree or Certified Accounting certificate preferred.
 
Experience
  • Significant and sound experience with multi national direct or indirect.
  • Direct knowledge and experience of managing anti trust and competition risk within the business.
  • Knowledge and experience of managing relevant ethics and compliance risks to include – bribery and corruption, trade compliance (export/import/sanctions), conflicts, gifts and entertainment, retaliation.
  • Experience in or understanding of the operations and organisation and processes of a multi layered International Corporation.
  • Experience in developing networks in cross cultural business.
  • Experience of effective cross functional collaboration
  • Strong personal integrity
  • Evolved ability to enrol “partners” inside[Company] , facilitate workshops and discussions, and to communicate the strategic vision for ethics and compliance.
  • Self-confidence to take a firm stand and energetic persistence in seeking solutions to complex issues.
  • High standard of analytical and drafting skills, with attention to detail.
  • Good communication skills with the ability to apply these skills at all levels of the organisation and with key external stakeholders.
  • Strong work ethic and creative ability to achieve identified goals, both individually and as a team player in a global function.
  • Effective problem-solving and planning skills with ability to see the big picture and follow through on operational detail.
  • Strategic and political awareness with evidence of using influence to effect change in the organisation.
  • Experience of change management.
  • Good self awareness and personal development.
 
 
Critical planning, prioritisation, influencing and oversight that mitigates or eliminates high level risks for the Group that could result in:
  • Material (up to $5 billion) criminal, civil and administrative damages,
  • Criminal prosecution of [Company] and individual employees (eg up to 20 years imprisonment for fraud or obstruction of justice, bribery or anticompetitive cartel behaviour, environmental violations),
  • Loss of license to operate
  • Severe reputational damage
